2. Scope and acceptance

By accessing or using the Website, you agree to these terms. If you do not agree, do not use the Website. You must use it only in compliance with applicable law.

These terms apply only to this public Website. They do not govern a subscription, product account, paid service, or use of Lead Research Agent. Separate terms presented with a product or agreed in writing apply to that product and prevail for its use.

3. Website content

The Website provides general information about NEXTCOG and its software. Product descriptions, examples, illustrations, roadmaps, and availability statements may change as products develop. Unless expressly agreed in a signed contract, Website content is not a binding offer, service commitment, warranty, or guarantee of particular results.

The content is not legal, financial, data-protection, compliance, or other professional advice. You remain responsible for assessing whether a product and its intended use are suitable and lawful in your circumstances.

4. Intellectual property

Unless stated otherwise, NEXTCOG or its licensors own the Website, including its original text, layout, graphics, illustrations, software, branding, logos, and other content. French and international intellectual-property laws protect those materials.

We grant you a limited, non-exclusive, non-transferable, revocable right to access and display the Website for your own lawful personal or internal business information. You may not reproduce, distribute, publish, sell, license, modify, create derivative works from, or commercially exploit substantial Website content without prior written permission, except where applicable law permits it.

“NextCog,” its logos, and product names are identifiers of NEXTCOG. No right to use them is granted except as necessary to refer accurately to NEXTCOG or its products.

5. Acceptable use

You must not:

  • use the Website for an unlawful, fraudulent, or rights-infringing purpose;
  • attempt to gain unauthorized access to the Website, servers, or connected systems;
  • introduce malicious code or interfere with the Website’s operation or security;
  • use automated requests in a way that imposes an unreasonable load, bypasses access controls, or disrupts availability;
  • remove ownership notices or misrepresent an affiliation with NEXTCOG; or
  • use Website content to build or promote a misleading or unlawful service.

We may restrict access where reasonably necessary to protect the Website, users, or third parties, investigate misuse, or comply with law.

6. Products and external links

Links to Lead Research Agent take you to a separate application. Product use may require registration and acceptance of separate terms and privacy information.

The Website may also link to third-party websites for convenience or context. NEXTCOG does not control or endorse a third-party website merely by linking to it and is not responsible for its availability, content, security, or privacy practices. Review the destination’s terms before using it.

7. Availability and security

We take reasonable care in operating the Website, but it is provided on an “as available” basis. We do not promise uninterrupted access or that all content will always be complete, current, or error-free. We may change, suspend, or withdraw any part of the Website for maintenance, security, operational, or business reasons.

You are responsible for the security of your device and network. Do not attempt to test or bypass Website security without our prior written authorization.

8. Liability

Nothing in these terms excludes or limits liability where doing so would be prohibited by applicable law, or affects rights that cannot legally be waived.

Subject to that rule, NEXTCOG is not liable for loss caused by reliance on general Website content, an incompatible or unavailable third-party service, or an event outside its reasonable control. For users acting in a professional capacity, NEXTCOG is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, or data arising solely from use of this public Website.

Any liability connected with a NEXTCOG product is governed by the contract applicable to that product, not these Website terms.

9. Privacy

Our Privacy Policy explains how we process personal data connected with the Website, protected contact form, and email enquiries. The public Website currently uses no analytics, advertising, or marketing cookies. The contact form uses Cloudflare Turnstile to prevent automated abuse.

10. Changes, law, and contact

We may update these terms to reflect changes to the Website, our practices, or the law. The date above identifies the current version. Continued use after an update means the updated terms apply from their effective date.

These terms are governed by French law. The courts with jurisdiction under applicable procedural rules will hear any dispute, without depriving a consumer of mandatory protections available under the law of their country of residence. Before starting formal proceedings, you and NEXTCOG should try in good faith to resolve the dispute by written notice.

If a provision is held invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver of it. These terms do not create a partnership, agency, employment, or joint venture.

Questions or notices concerning the Website may be sent through the contact form or to 73 Boulevard de Strasbourg, 34000 Montpellier, France.
